The Draft bylaw was approved for public consultation on 9 May 2011 and was confirmed by Grey District Council on 13 June 2011 following consideration of submissions received as part of the Special Consultative procedure.
Explanatory Note
Pursuant to the provisions of Section 105 of the Local Government Act 2002 and any Acts passed amending this Act, any other enabling legislation, the Grey District Council herewith, by Special Order, make and adopt this Bylaw.
Title
This Bylaw will be known as the Grey District (2011) Access to Walkways/Cycle Track Bylaw.
Date of Coming into Force
This Bylaw will come into force from 13 June 2011.
Purpose of Bylaw
The purpose of this Bylaw is to prohibit the use of motorised vehicles (including motor cycles and three and four wheel vehicles) but excluding an approved motorised disability wheelchair operated by a person with a bona fide physical disability necessitating the use of such wheelchair as well as any maintenance vehicles commissioned by or on behalf of Grey District Council, from accessing and using the walking tracks/cycleways identified herein and to provide for general conduct of users of such tracks.

Bylaw to Prevail
This Bylaw should be read in conjunction with all other Bylaws and, where this Bylaw is inconsistent with any other Bylaw, the provisions of this Bylaw shall prevail.
Interpretation
In this Bylaw, unless inconsistent with the context:
Council means the Grey District Council.
Motorised vehicle means any vehicle or cycle powered or otherwise mechanically propelled but excludes disability scooters used and operated by bona fide people with a disability, pedal or push powered cycles with battery or small motor propulsion assistance and bona fide maintenance vehicles commissioned by or on behalf of Council.
Walking/Cycling Tracks refer to:
- The walking track at the base of the Former Cobden dump site.
- The Grey District portion of the Greymouth Station to Ross Cycle Track identified as such by signs and notices.
Prohibition on Access to or Use of Walking/Cycling Tracks by Motorised Vehicles
The walking and cycling tracks are meant for the exclusive use of walkers, joggers, cyclists and people with disabilities using conventional mobility scooters in a responsible manner.
The use of any motorised vehicle on any part of the walking/cycling tracks is specifically prohibited.
Pets and Animals on Walking/Cycling Tracks
All dogs on the walking and cycling tracks must be on a leash and under the control of their owners/handlers at all times.
Access to the walking and cycling tracks by horses, mules and other such animals is specifically prohibited.
Offences and Penalties
Any person found to have contravened the provisions hereof or who have been reasonably accused of doing so will be prosecuted and, apart from any punitive measures the Court may impose upon conviction, will be liable for payment of the following charges with Council reserving the right to request the Court to confiscate the motorised vehicle used during the contravention as security for payment of the charges in full:
- The full cost of repairing any damage caused by the contravention including administration costs.
- Council’s reasonable cost of attending the call-out and investigation of the contravention.
- Any legal and related costs associated with the Court process.
